Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

Cooling-off Period: The period during which the consumer may exercise their right of withdrawal.

Consumer: A natural person who is not acting in the course of a profession or business and enters into a distance contract with the entrepreneur.

Day: Calendar day.

Extended Transaction: A distance contract relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.

Durable Data Carrier: Any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.

Right of Withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.

Entrepreneur: The natural or legal person who offers products and/or services to consumers at a distance.

Distance Contract: A contract concluded within the framework of an organized system for the distance sale of products and/or services by the entrepreneur, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract.

Means of Distance Communication: Any means that can be used for concluding a contract without the consumer and entrepreneur being simultaneously present in the same place.

Terms and Conditions: These Terms and Conditions of the entrepreneur.

Article 3 – Applicability

These Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these Terms and Conditions shall be made available to the consumer. If this is not reasonably possible, it shall be indicated before the conclusion of the distance contract that the Terms and Conditions can be inspected at the entrepreneur’s premises and will be sent free of charge to the consumer upon request as soon as possible.

If the distance contract is concluded electronically, the text of these Terms and Conditions may be made available electronically in such a way that the consumer can easily store them on a durable data carrier.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Any situations not covered by these Terms and Conditions shall be interpreted in accordance with the spirit and intent of these Terms and Conditions.


Article 4 – The Offer

If an offer has a limited period of validity or is subject to specific conditions, this shall be explicitly stated.

The offer is non-binding. The entrepreneur reserves the right to modify and adjust the offer.

The offer contains a complete and accurate description of the products and/or services offered. The descriptions and images are intended to provide a truthful representation of the products and/or services.

Obvious errors, mistakes, or inaccuracies in pricing, product descriptions, or images are not binding upon the entrepreneur.

Product images are indicative. Colors displayed on screens may differ from the actual product colors.

Each offer contains sufficient information regarding:

  • The price of the product or service;

  • Any applicable shipping costs;

  • The method of payment;

  • Delivery and execution of the agreement;

  • Whether the right of withdrawal applies;

  • The period during which the offer remains valid.


Article 5 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and complies with the associated conditions.

If the agreement is concluded electronically, the entrepreneur will promptly confirm receipt of the acceptance electronically.

The entrepreneur reserves the right to refuse an order or impose additional conditions if there are legitimate grounds to do so.

Every agreement is concluded subject to the availability of the products concerned.

The entrepreneur will provide the consumer with:

  • Contact information for complaints;

  • Information regarding the right of withdrawal;

  • Information regarding warranties;

  • Information regarding after-sales service where applicable.


Article 6 – Right of Withdrawal

For the purchase of products, the consumer has the right to withdraw from the agreement without stating reasons within 100 days after receiving the product.

During the withdrawal period, the consumer shall handle the product and packaging with care. The product may only be unpacked or used to the extent necessary to determine its nature, characteristics, and functioning.

If the consumer exercises the right of withdrawal, the product must be returned with all supplied accessories and, where reasonably possible, in its original condition and packaging.

To exercise the right of withdrawal, the consumer must notify the entrepreneur in writing or by email within 14 days after deciding to withdraw.

After notification, the consumer must return the product within 14 days.

The consumer must provide proof of timely return shipment.


Article 7 – Costs in Case of Withdrawal

The costs of returning the product are borne by the consumer.

If the consumer has already made a payment, the entrepreneur shall refund the amount as soon as possible and no later than 14 days after receipt of the returned product or proof of return shipment.


Article 8 – Exclusion of the Right of Withdrawal

The entrepreneur may exclude the right of withdrawal for products that:

  • Have been manufactured according to the consumer’s specifications;

  • Are clearly personal in nature;

  • Cannot be returned due to their nature;

  • Are liable to deteriorate or expire rapidly;

  • Are subject to fluctuations in the financial market beyond the entrepreneur’s control;

  • Consist of newspapers or magazines;

  • Consist of audio/video recordings or software where the seal has been broken;

  • Consist of hygienic products where the seal has been broken.

The right of withdrawal may also be excluded for services:

  • Relating to accommodation, transportation, catering, or leisure activities on a specific date;

  • That have begun with the consumer’s explicit consent before the withdrawal period expired;

  • Relating to betting and lotteries.


Article 9 – Prices

The prices of products and services shall not be increased during the validity period stated in the offer, except for changes resulting from VAT adjustments or legal regulations.

The entrepreneur may offer products whose prices are subject to financial market fluctuations with variable pricing.

All prices are subject to typographical and printing errors.

The entrepreneur shall not be liable for obvious pricing errors and is not obliged to supply products at incorrect prices.

Where applicable, import duties, customs clearance fees, and import VAT are the responsibility of the customer.


Article 10 – Conformity and Warranty

The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, reasonable standards of reliability and usability, and applicable legal requirements.

Any manufacturer’s warranty does not affect the consumer’s statutory rights.

Defects or incorrectly delivered products must be reported in writing within 14 days after delivery.

The warranty does not apply if:

  • The consumer has repaired or modified the product themselves;

  • The product has been used improperly;

  • The product has been exposed to abnormal conditions;

  • The defect results from government regulations concerning materials or product standards.


Article 11 – Delivery and Execution

The entrepreneur shall exercise the utmost care when receiving and executing product orders.

Accepted orders shall be processed as quickly as possible and no later than 30 days unless a different delivery period has been agreed upon.

If delivery is delayed or cannot be completed, the consumer shall be informed within 30 days after placing the order.

In such cases, the consumer has the right to terminate the agreement free of charge.

Any payments made shall be refunded within 14 days after termination.

The risk of loss or damage to products remains with the entrepreneur until delivery to the consumer or an appointed representative.


Article 12 – Duration Transactions: Termination and Renewal

The consumer may terminate an agreement concluded for an indefinite period at any time, subject to a notice period of no more than one month.

Fixed-term agreements may be terminated at the end of the agreed period with a notice period of no more than one month.

Automatic renewal of fixed-term agreements is only permitted where allowed by applicable law.


Article 13 – Payment

Unless otherwise agreed, payments owed by the consumer must be made within 7 working days after the start of the withdrawal period.

The consumer is obliged to immediately report inaccuracies in payment details provided or stated.

In the event of non-payment, the entrepreneur is entitled to charge reasonable costs previously communicated to the consumer, subject to legal restrictions.


Article 14 – Complaints Procedure

Complaints regarding the performance of the agreement must be submitted to the entrepreneur within 7 days after the consumer discovers the issue.

Complaints will be answered within 14 days after receipt.

If a complaint requires a longer processing time, the entrepreneur will provide confirmation of receipt and an indication of when a more detailed response can be expected.

A complaint does not suspend the entrepreneur’s obligations unless agreed otherwise in writing.

If a complaint is found to be justified, the entrepreneur shall, at its discretion, repair, replace, or refund the product.


Article 15 – Disputes

All agreements between the entrepreneur and the consumer to which these Terms and Conditions apply shall be governed exclusively by Dutch law, regardless of the consumer’s country of residence.

Any disputes arising from or relating to these agreements shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
